Shared custody
May 21, 2020

When the common life of a couple is broken, the custody of minor children can be shared between the parents.

That is to say, the care, education, and, in general, the habitual coexistence of minor children can be attributed to both parents, with equal conditions and rights.

In this way, minor children can be in the company of their parents in alternating periods (fortnights, months, quarters...).

Until a few years ago, exclusive or single-parent custody (attributed to only one of the parents) was the majority option. However, it is increasingly common to establish a shared custody regime.

This type of custody has been gaining importance in Spain in recent years, already representing 33.8% of the custodies granted in Spain in 2018 (the last year for which there are complete statistics).

This rise is due to the fact that shared custody is considered by experts to be the most beneficial for the interest and proper development of the child.
